Post Mazda Forums Vs MAM

I want you guys to know...I would be willing to host and promote some sort of organized front against MAM to resolve outstanding issues...Maybe a class action law suite? Let me know what you think...

NOTE: We will make sure those involved have a honest claim against MAM.

Let's get some ideas going in this thread on how we can help you guys out!

Class action suit in this situation is a waste of time.

you probably couln't find a lawyer that would take the case as a class action anyways.

one lawsuit with a bunch of pissed off people wont do much. you need many individual lawsuits to really create a spark.

See the problem is Antoine, this should have been done a while ago. The administration team and moderators should have been able to put on the pressure on MAM, including the so called MAM representatives.

Now that Beau is no longer a vendor, nor has any valid contact information, he has no obligation to respond to anthing on these forums. Basically he pulled another fast one.

I guess when moderator team had been dazzled by Beau brilliance once upon a time, don't get me wrong but he does make quality products, but once that wore off, they never realised that they were being baffled by his bullshit. Hopefully a lesson learned, albeit a very expensive lesson for the members of these forums. Other vendors have been forced out, and yet others have decided not to continue on the forums because they were being bashed all the time in favor of MAM (case in point: Nick).

This situation should have been handled similarly to the situation with Ion Performance. A thread was started with all the people owed money to, and then pressure put on Jack to deliver. In the end, 99% people owed product to, received their Ion Performance products. Again, another quality product, lost maybe forever. The only thing, is that Jack from Ion really did not know how to handle his time, and was not mal-intentioned with the customers.

So the only recourse now, is to continue that MAM thread or start a new one, case per case, listing what people are owed by MAM, posting of all private messages, so that a timeline can be established. This way the forum members can see all the bullshit lies and excuses, and someone seeking legal recourse, may have a base established from which to go on.

As for Mazda forums being able to do something, don't forget you are no longer engaged in a legal contract with MAM as an advertiser or anything for that matter.

I have talked to my lawyer about this situation, and his suggestions was that if any legal action was to be taken, was to start not just an electronic history of communication, but also a paper trail. By sending mail with a recieve signature (registered mail or something like that), you have proof that MAM is getting complaints in a timely fashion and not dealing with them. Then in the future if legal action is taken, you have physical proof, not just forum threads. I have said before, i have very little experience with all this stuff, but thats the one suggestion the lawyer i talked to about this had to say. So that means, if ANYONE has gotten a package or refund in the mail with a legible return address on it, could you please let us know what it is? Or even if we can put together a couple partial ones to get the full address, then we can go from there.

MAM is not banned as a regular user, but no longer may perform business on these forums.

Send certified letter requesting info, part or refund.

The certified letter should be the first step.This will let you know if they are still in business or at least receiving their mail. This will also establish a physical address to contact them through.
It is now obvious that the money they were receiving from say myself on 8/4/06 was used to manufacture something that was ordered long before my order. Call it what you want, robbing Peter to pay Paul, the shell game, slight of hand, whatever. My guess is they thought that they could fabricate the parts with the money they would make from previous orders, much like a gambler thinks that he can get out of the hole he is in when the odds are with the house. This with the numerous requests for refunds put them up shit creek with out a paddle. I will be requesting my cc company for a refund if the certified letter is returned.

Guys...This thread is intended for ideas...The class action suite is just an idea!

For the record...I've already setup two threads in the past strictly for MAM customers with outstanding issues (parts or refunds). Both threads did help some members to resolve their issues with MAM. However, now we have a different situation with MAM OFF the forums.

Also for the record: I personally shut down MAM once before and only let them return because the members gave the "OK". So let's move on from the past and concern ourselves with the present.

No doubt we need to get organized and keep the commentary to a minimum!

I think some sort of "legal" approach...at this point is worth a try. Like some people said...A "paper trail" is very important. We need evidence!
