well, i never thought i would happen to me, i always though my car's handling would save me from an accident..boy was i wrong.i just got off the phone with the insurense person and i have a couple of questions...but first the story

I was driving down 595 W going about 60-70 mph at 6:30pm, i'm in a slight hurry cause i wanna go to autozone and have a CEL code checked, then i wanna go to radioshack and buy an xmod after a long day at work. So i'm driving and some asshole just cuts me off, so i get mad and pass him to give him that "f*** u" look, i took my eyes from the road for an instant, then i look ahead and a toyota corolla is standing there, i slam the brakes and hold on to the steering wheel, the more i think about it, the more i realize i could have steered the car and have easily missed him, but i didn't think straight for those 2.19 seconds.....i hit him anyway, god knows at what speed, parts go flying and my car finally comes to a complete stop, white smoke coming off my now bend hood. i get off the car and almost colapse from the shock, luckily, like always, i was wearing my seatbelt, the other guy wasn't hurt (THANK GOD) and after i shook it off, neither was I

here r some pics of the damage

look what came in the mail...

luckily, the engine itself wasn't hit, so after i tied the hood down, i was able to drive the car home

i had to cut/remove/bend/brake some parts from the car to be able to make the trip

The cop put down that i was driving without care and gave me a ticket, i don't have a pic of the other guys damage, it was kinda bad but since we both have insurence, it won't be a problem and he was really cool about the fact that i had just ruined his whole week/month

So now for my questions..

-Will the body shop give me problems for my mods? will they remove them?
-Will mazda give me a free loaner since i will most likely drop it off there, or at least, give my mom the rental and i'll drive hers?
-is it illegal for the body shop to install parts from other cars? i want them to put a p5/msp front bumper instead of the ES?
-can they put other stuff on the bill, and charge the insurence for them? like a dent removal, or a shaved trunk?

I know i shouldn't be thining like this, but i'm trying to see some positive from all my negative

usually an insurance adjuster works with the body shop. They will usually come out and give you an initial estimate and go from there.(usually a low number and the body shop has to get more money from them) or you can take it to a body shop, get the estimate and take that to the insurance company, and if there is unseen damage the bodyshop will contact the insurance about it. And there are some ways to get other stuff done but i wouldnt consider it legal. And you could probably talk the bodyshop into putting a p5 bumper on

no loaner. this was an accident. unless you are going to pay extra :(
the body shop should care less about the mods, though if some are broke, they will be replaced with stock, if anything.
the body shop should replace a part with whatever you request. I brought my dealer a junk AC compressor, they installed it no probs.
no shaved trunk, etc- unless you know them personally. ONLY if it was damaged is it covered- so no, insurance wont pay for anything other than to get it back to stock.

Glad to hear no one was hurt.

mazda won't give you a loaner, however if you have it in your policiy your insurance will.

the other stuff would be up to your insurance adjuster and he bodyshop.

insurance SHOULD fix it like it wasbefore it was hit.. not to stock.. if would wreck my car, the insurance would have to get me a new body kit front bumper, not a stock.. i made sure of that when i was gettin my insurance..

Basically if you have a picture of what it looked like before, that is what it will look like when it is done, but if the p5 bumper is cheaper the insurace comp will go with that cause it saves them money, thats the only way you get to change things..

thanks for the info
i just got finished taking off someparts that i wanna keep (fogs, bolbs...) i'm really going to shoot for the p5 bumper. And i figured the shaved trunk would be a no no.

I also just found out my insurence covers the first 350 bucks for a rental car (yippy)

Damn, It looks worst than it is, the engine still starts up and runs pretty good, and no one got hurt. try to get the mp3/p5 bumper and then a lip, that WILL look 100 times better than what you have now. Good Luck.

almost looks like what my wreck did. not too bad, just hope you didnt bend the frame like i did. but the insurance laws say that they have to fix your car to its previous running order, so if youve got an injen intake and it was damaged, you get a new one the exact same as the previous one. they have to replace every part that was damaged with identical ones. but one piece of advice ill give you...be picky! if you dont like it, make them change it. and dont let them fuck you, cuz they will if they get the chance (especially insurance companies). and now might be a good chance to upgrade parts like a cf hood. they dont cost that much more (if more at all) than stock parts, and while you might have to pitch in 100bucks or so, its alot cheaper than 650 when you decide you want one later. most body shops are pretty cool with this, as long as no extra money is going to be coming out of their pocket.

mods will be replaced with mods, most insurance companies have like a 1000 dollar mod coverage (progressive did) to cover them........ i got in an at fault accident and got my hood and a few other aftermarket stuff replaced even my damn grafix.....
plus mine was alot worse...............

yeah...i just went through this mess. body shops can legally replace parts with parts off of another model in the same model years. as with mine thats what they did. they took the door, fender, and front bumper off of an 03 es and put them on mine. heres what mine looked like. this is what happens when a drunk behind the wheel of a 03 wrx decides to take a corner at 50 mph on a wet road:

also if there was damage in the area of impact before the accident occured and the insurance doesnt know that, then it'll get fixed as well. as you can tell...the bumper, headlights, grill and hood were all messed up before when i rear ended someone who cut me off at 30mph. so yeah, i just hope that your insurance company is better than mine. it was a month and a half long nightmare and i have it back now but it still has things wrong with it that need to be fixed:
no side molding on fender or door plus no lx sticker:

2 different headlights:

and the driver side front rim is bent along with a few dings and scratches i noticed that are now on my car that werent there before.

If the ES and the P5 front bumpers are the same price..there shouldn't be a problem. Or you have to pay extra as to which one is more expensive. The MSP front lip is gonna cost you because it's not part of the initial bumper. I had an mp3 bumper ordered instead of the p5 bumper w/ the sidemarker lights when I went to the body shop.

Body shop won't give you problems w/ your mods. Unless they're extensive, like a turbo kit and such. They'll put it back to stock and probably refer you to an actual shop to re-install the mods.

Well, the car is at the shop right now, jason, the guy that handled my claim, says the p5 bumper won't be a problem but that the wiring harness for the fog lights may not match, i told him to just put it in and i'll fugure out a way to make them work.

as far as mods, i don't really mind them putting it back to stock, it basically only has the intake, so it's not too bad

Now i'm stuck with a mitsubishi galant for at least 3 wekks :(

i feel for you. i had a toyota echo for a week and then a lancer for 1.5 months. but i suppose the lancer wasnt that bad of a car, after all it did make it through my driving (and a little 4x4 trip through the forest, hehehe).

actually, with the bulbs that i have in there, the chrome housing makes it look brighter so i'm getting another chrome housing. just have to wait for them to get it in. i wasnt a fan of the black housing to begin with. i tried to get them to get a p5 bumper but they said they couldnt cause the insurance wouldnt authorize it. same with the p5 headlights that i want, even though the p5 headlights cost 10 bucks cheaper then the all chrome ones.
