Someone please help me!

This is kind of a long story, but I'll try to keep it simple.

I won that auction last weekend. I emailed the guy asking about the offset & to confirm that they were black & got no reply. I didn't want someone else buying them before me, so I did Buy It Now & then he replied right away (his ebay email is probably something else that he doesn't check). We talked back & forth on email a few times & I finally spoke to him on the phone Thursday night. He is local, so I said it would be easier if I just came over & picked up the wheels & I could also just hand him the cash that way (easier for both of us, no shipping, I get to inspect them before I pay). He told me that the only time for me to pick them up would be at like 11PM, but since it was like 10:30PM on Thursday, I asked if I could just come over that night. He said that was fine & I was gonna go get the $$ together. Right before I left, he called & asked if I had left for his place yet (he gave me directions to like the street, but no actual address yet). I told him I was just leaving & he said that his friend had to take the car for something & that Friday night at the original time would be 100% better. This WAS an inconvenience for me, but I said sure, no problem. He still had the wheels & tires on his S2000, which was understandable & I had loaded up my jack stands & floor jacks to help him get them off. What I didn't like was that I had already won the auction & even though I hadn't paid him yet, those wheels & tires are auction goods that I am paying for & his friend shouldn't be driving around on them. Like if I order a PS2 from Best Buy, I'd expect that the shipping guys wouldn't be playing SOCOM on it before they sent it to me. Anyway, I waited till Friday night & called around 10PM & got no reply. Besides his email, all I have is his cell #, but the guy never set up his voicemail, so I can't leave any messages. From 10PM to after 1AM, I must have called him 30 times, but I got nothing every time.

I have since emailed him twice & tried calling yesterday & today. In the email today, I told him that he needs to contact me by the end of today or I will file a claim through SquareTrade (www.squaretrade.com (http://www.squaretrade.com) online dispute resolution with eBay). I haven't paid him anything, but I already received the $$ from the person who is buying my wheels & now I have to figure out what to do with that part of this.

Does anyone have any suggestions as to what I should do? :confused:

The feeling that I get is that he sold the wheels to someone else & is just trying to avoid contact with me, hoping that I will go away. Even though I haven't lost anything (because I didn't pay him yet), this screws up all my plans & I have no intention of just letting it go.

Man, you just gotta love ebay sometimes, i had a similar prob, not with wheels though. That is going to make you look bad the person you sold your wheels to.

He sent me a check for my wheels & as soon as I got these, I was gonna drive up to Orlando to give him my RHs. It's a good thing that I didn't cash his check because I was waiting to confirm things with the S2000 guy. The point is I want those wheels & Andrew wants my RHs.

BUMP...I don't know what to do at this point besides the SquareTrade thing, but I don't know if that will work because I haven't paid him anything & he seems to be avoiding communication with me.

Any eBay pros know what you can do if a seller won't send the item you won?

i used to sell stuff on ebay all the time but lately i stopped so i don't know what kind of advancements they made in problem resolution and the time it takes. but i remember that they would just say that you have to try to contact the other party for 30 days and if nothing happens then you contact them and nobody knows how long that would take. i don't know how long it would take squaretrade to figure this stuff out but i am sure its not going to be in a couple of days especially if the moron is not cooperative. so what i am getting at is, i don't know how long lasermp5 want's to wait for your rims, but you should start looking for another buyer just in case lasermp5 has to pull out from the buy for whatever reason. this way if it gets solved and you get the rims, you have another guy to sell your rims too if lasermp5 changes his mind.

The guy already sounds like enough PITA that I wouldn't even bother finishing the deal with him. Just cancel that deal and then give lasermp5 his money back to (and basically start over). It sucks, but at least nobody gets screwed out of any money that way. At least that's what I'd do. Oh, and definitely file a complaint with the square trade thing -- can't hurt.

Bolt pattern is 5x114.3 & stock offset is like +60, but they run +45 to +55.

OK, I filed my claim through SquareTrade & opted for the mediator. If he agrees to it, I only have to pay $20 for the service. I'm not sure if they will have any better luck contacting him than I did.

Just wanted to update this thread. I got an IM last night from a guy who explained everything to me. Apparently James was in the middle of selling his S2K to this guy Alex when I was supposed to pick up the wheels & he was trying to find stock wheels to replace the Rotas. When he told me something came up, it's because he had actually just sold the car. Anyway, Alex is the one who IMed me last night & he has no idea why James didn't just tell me. All I have to say is that James is lucky that I'm a patient person & made every effort to rectify the situation instead of just giving him bad feedback & posting a thread on S2Ki or w/e. Alex was nice enough to make me the same offer on the wheels & tires since I won them on eBay, so hopefully I should be getting them really soon after all. It's a good thing too because almost everyone I see has been saying "I thought you got new wheels." :D
