I just bought an mp3 from miami with only 9600 miles, and i got it under the assumption that it was still under the bumper to bumper warranty. A week later my third gear starts grinding so i took it to mazda just so they could tell me that the previous owner had the transmission opened before by a non mazda dealer based on how it was sealed so they void my warranty for my transmission. Just last week my car gets stuck in i believe 4th gear and it wont go into any other gear. I've been reading up on the forum and it seems not just a few people have this problem but just about EVERY mp3 owner has had that problem. Knowing that its a broken shift fork and mazda knowing that the fact that it was opened by a non mazda dealer more than likely had nothing to do with the fact that i have a broken shift fork, is there anyway i could fight mazda into fixing it since its a design flaw that they probably are still not doing much to take care of especially since they know most of our warranties are about to be or are already up. Someone please help me out if they know what i could do.

There probably isn't any way you could fight them, it WAS opened and it wasn't by them....

I understand that it was opened by someone else but common now its a known fact that the tranny is a piece of shit and there is no way they can tell me thats why the shift fork is broken.

it seems like they should have told you this when they sold it to you...or something...kinda not fair really to be in your situation.

did you buy it from them?

You said you where under the assumption that it was still under factory warranty. Did the dealer you bought it from tell you it was still under factory warranty. Maybe they can do something, or you can take action against them. *shrug*

oopps, dexter beat me to it.

No i bought it from a private owner in miami, I didnt understand why the guy i bought it from would have needed to take it to a non dealer in the first place but the car is lowered so maybe thats why.

Basically the guy screwed me royally because he never told me that he had the tranny opened up by someone else. I bought it on ebay like a dumb as cause i was soo caught up in the fact that its had less thank 10k miles. He posted it on ebay with the factory warranty.

Ouch, from a private seller, looks like your on your own on this one. Try to find a used low mile tranny from here. (http://www.valuparts.com/)

I believe all the trannys are the same, only the MSP has different forks. If you do get it fixed, get those forks I guess.

As for the tranny problems, there are a number of them, but not ALL MP3s have had this problem. In fact a lot of boosted ones have not had this problem. Mind you I worry about my tranny because of the crap I hear, but it hasn't let me down (knock on wood).

Sorry to hear of the problem though, it sucks. I would guess you could try to take action against the seller since he said it was under factory warranty, but it would likely be messy. Get an estimate of the repair and decide from there.

Real sorry though, that blows!

I DONT KNOW thats what makes it so much harder on me i can understand if the car was not warrantied and he got so much mods that he couldnt but he had NOTHING done to the car. He was probably such an idiot and didnt know SHIT about cars and probably has no idea what the meaning of the word WARRANTY is.

I track the guy down and ask why the fuck he said it staill was under factory warranty and its not (at least the tranny is not).

I would try and get some money out of the guy.

At least to cover some of the cost to fix it.

yea actually thats what i need to find out does ebay take action against people that place false information on the items they sell because he clearly had it posted that it was under full bumper to bumper 3 year 30,000 miles warranty and clearly he voided the warranty for the tranmission.

Yes.
Ebay does take action.
But its somewhat of a long process.

If you like the car other than this issue, I would track the guy down and get him to pay for some or all of the repair.
If you have more issues with it, I would try and get the $ back through ebay (but will most likely be long and drawn out).

Last, you may want to check and see if the engine is still under warranty. Hopefully just the tranny was opened up and not the engine too. Otherwise they may give you the same line.

yes i had it checked by mazda and they said it is just the tranny thats voided i just had new shift knobs and rim cap and steering wheel installed all under warranty they just refust to touch my tranny. And yes i have the guys full address and phone number and as a matter of fact he already owes me 500 dollars for an amp i bought through him and never got. How do i contact ebay and talk to them about the problem?

Once again, the tranny problem. If you know how to shift it won't break on you again.

It probably broke the first time on you because of the previous owner.

If you get it fixed and shift like a human being and not try to force it, it'll last a good long time. If you think it'll still break, the clutch release fork is what you can replace from the MSP. The rest of the shift forks are the same.

All tranny's in the third gen are the same, except for the differences in the MSP tranny.

Yeah, its a misconception that the tranny sucks in our cars. People break forks by slamming the shifter into gear, and/or using them as handrests. My suggestion is to just get a used low mileage one, and don't beat on it. People with 230whp turbos have had their stock tranny for over a year (spoolinmp3 for one example).

I say ebay won't do shit for you. There are probably thousands of claims just like yours that they receive on daily bases, it's impossible for them to do anything.

Did you ask your mazda dealer how much it's going to cost to get it fixed???

i feel for you man, my tranny went on me a month ago, same problem, 3rd gear was grinding, got stuck in 4th gear. Then one day i noticed fluid leaking from under my car, turns out it was tranny fluid, i am thinking oh great now what. I take it to the dealer, and they fed me corporate bullshit about how i over torqued it with my parts, and i told them bullshit, then they tried to tell me how i drive, and said that is the reason. They said you probably took it past redline, which i have never done, anyway, they said you probably took it close to redline one time and that is what caused it. Turns out i sheered something in the differential, and i also broke the first gear lock somehow. The MP3 tranny is achillies heel of the car. Good luck with mazda they are a bunch of F***ing a$$holes with their thumbs up their a$$es. Since that experience i have decided to get rid of my car, and move on to another, which car, i have not decided yet.
