Hey everyone,
Don't know if any of you heard but....
My beloved MSP burned down in a shop fire with a few other cars
Before:

One of the owners of the shop was messing with the fuel pump of his race car when it sparked and ignited him and the shop, he survived with 2nd degree burns all over, there was only one casualty, a Tea Cup Chihuahua named 'Toby'.
A few other cars burned down too, 2xS2000, 700hp Race Civic Hatch, 400hp Race Civic Coupe, Eclipse, 240sx, Civic Hatch, Civic Coupe, Integra, Del Sol.
From fire start to everything burned to a crisp was est. 3 min.
Sad times.

Yeah, it's a tricky situation, shop didn't have insurance but in NC it is the law to rent out a building with reters incurance and the landlord didn't have insurance either so the shop owner is taking the landlord to court, it was my buddy's shop, he is gonna pay me out when he gets some cash, he lost about 105k through all of this

Dang dude! Thats quite sad knowing something you put that much time, money, and efforts into is now just destroyed. I know how you feal. I was helping my brother rebuild his engine in his 01' Subaru 2.5 RS and a spark ignited some fuel in the engine bay. Fortunately it didn't cause much damage cause we had a fire extinguisher in the house. That is why it is so important to have one around a shop aspecially when its used for automotive purposes. You never know how or when something could go up in flames. Sorry for you loss. Hope everything works out for you. Have you talked to your insurance company to see if they will cover it?

I would assume the liability would rest on the property owner...regardless of the business owners own fault in the matter...Somewhere down the line someone really F'd up and didn't pay for insurance...and this is what happens...
Really it isn't your fault, even if you had insurance, your personal insurance would not pay for this, this is the business owners fault..and should be taken care of...suckage.!!!!!

Here's the fun part: If Jacques had insurance, he'd be able to a) get the car written off as a total and probably paid off by gap insurance (if he had it), and the insurance company would go after the shop / land lord to get their insurance to pay for it. As it stands, you have to fight this one on your own (with a lawyer preferably... that you have to pay for), and you're stuck in a pretty pickle.

Make a for sale thread for it in the Vehicles for sale section of the forum and explain your situation. My might get some luck that way.
Also you might want to talk to a few dealerships to see if they would trade you straight across for a beater car and have them pay the remaining on the car.

WTF, how did he pay off the fire marshal? Also, how do you know about it? You can probably get that investigated. If the guy was trying to claim fraudulent insurance, why would he burn himself and get 2nd degree burns on his whole body. That makes no sense.

i just feel really stupid for cancelling the insurance that's all, the landlord is one of the richest guys in the county that the shop was so he is in good with some people, including the fire marshall, so he paid him, my friend has a lawyer to take care of all this but he has no money to pay him right now so he has to wait to get money before any of this moves forward

Oh I see. I didn't catch that sorry. I only read in the first page of the thread that the shop didn't have insurance but the landlord should by law have some sort of renters insurance and didn't have it.
I guess fire and theft insurance should have been on the car at the very least. I think that type of insurance contract is really cheap, here in Can at least.

Go to your local Law school and talk with someone, They actually have people sometimes graduating seniors sometimes actual faculty that are willing to take cases for free, either to build up experience, or to use the case as a teaching tool. Either way someone will take the case, or atleast give you some counsel.

Sorry about your car. This is a mess as the shop owner should of had Garagekeepers insurance with a limit high enough to protect the owners of all cars that are now totaled. Even if you had comprehensive coverage you would have a fight on your hands as the car was in the care, custody and control of the shop and not you. The building owner was not responsible for the fire or the tenants property, no liability there. Your legal issue is with the shop. Good luck.

damn man just read the whole thread, that's a pretty bad situation. but hey from past experiences lawyers when taking on cases similar to this will, at times, operate on a "contingency fee contract" meaning they get X% of what you get. i'm sure your buddy is looking into it but if not you should mention it. Sounds like that case could go pretty high. Maybe you should get a little extra for the hastle......you know it's the american way. Good luck.

Aren't there lawers that only get payed if they win the case? And even then only a percentage is takin from the settlement for lawer fees. Don't have a whole lot of knowledge about law but I thought this was true.

^It is but like i said, the common misconception is that everything can be done on contingency fee basis. I know for a fact criminal charges can never be done as contingency fee, and some civil matters cannot be charged as contingency fee either. My suggestion would be to shop around for a lawyer who might take it , a majority will give you a free consult to see if they want the case. That is the best way, also call your local bar association and ask who they would reccomend for this case and they will give you a list of names and numbers (at least they should) , just because they have an ad in the phone book does not make them a good attorney. i will see if i can find out if this does qualify for the contingency fee basis.

Oct. 20th, for speeding, 96 in a 65 in a rental Explorer on my way back to Charlotte from Atlanta, all my fault, no one elses, lessons learned and noted in sharpie
(in NC, if you get stopped for doing 25mph or more over the speed limit it is an automatic 1yr suspension)

So is your liscense being suspended for a whole year then? I got mine suspended for a month once because I payed a ticket late. I see you got rid of your benz though! Thats good news. I am considering just giving my car back to the bank as well so I don't have to worry about getting a few things fixed on it. Bin out of work for a month or so and can't afford the car payments anyways.

Yep, gon for a year but I am eligible for a hearing which i'm still awaiting the papers for since I can do it through the mail, i'm certain I'll get it back though, I got a letter from my working stating that I need it for work and that if I don't get it back I could lose my job, but I won't lose my job, just a scare tactic :) .Smartest thing I did was giving the Benz back, just keep in mind, it will go on record as a repo for 5 years, i'm 21, i have some time to rebuild my credit

Yah, I selling all the aftermarket parts off my car and using it to buy a car with cash. So yah. Will not have to worry about credit for a while.

UPDATE: filling in the papers and sending my letter to the NC DMV today, I hope they find it in my favor and I get my license back or atleast reduce the amount of suspension time, I did alot of brown nosing and I hope it pays off!

nah, have never and will never touch that stuff or any other drug.
License suspension date was 10/20/08 so they cut it down to a six month suspension and ended up with that date

i don't know where it is or what happened to it, i was here in TX, i'm guessing everything was taken away to a scrap yard, would have liked to maybe try and salvage the wheels atleast

I would think you would have been able to salvage the chassi as well. Would have probably got a little money from the junkyard for it

Yah, it is to bad that a lot of the lawers out there are just greedy and selfish and not willing to help people with these kind of situations. I am sure there are some out there though that would be willing to help you without handing over your left arm. Just got to find them

Well not sure if your a believer or not but god does all things for our good. Sometimes you got to climb out of the pit to gain strength so you can stand when your out. Plus your experience in these troubled times could help someone in a similar mess in the future. Just gotta stay positive and things will be better soon. Hope you get things figured out. Godbless!
