This is what happens when you decide not to hit the dog running in front of your car at 2 am......locked up brakes....car decided to jump to port....spin in the median...driver's side hit tree....ca bounced off of tree....then onto road. No injuries besides my baby. Cops had the balls to give me a citation for Careless driving!!!! $121.50. Anyway, onto the pics...

Damn dude that really sucks...atleast your ok..hopefully the insurance got ur back.did the cops ask you how fast you were going??i'm saying thats totaled..Good luck with the turn out.

Yeah I held the wheel straight...I will post pics of the scene. I started straight but somehow went to the left and spun...almost as if back end swung around on its own. Insurance Adjuster is coming tomorrow...several welds have serious fractures....they would have to replace the whole and I mean WHOLE from end. The tranny is gone too...only 2nd gear. I hope it is totaled so I can start over...I don't like driving cars that have had this much work done to fix. I added up replacement parts from what I have looked at and without labor, already up to 12000. It should be totaled. Will keep everyone updated....now posting the scene pics.

Dude you can get out of that ticket easily. Take it to court and plead not guilty. Any judge that finds you guilt of that should have his dog taken out and run over to see how it would feel......

I agree with not pleading guilty.... that's sound advice no matter what!
As far as the accident goes... a tip of the cap to you for not hitting the dog. Cars, as much as we love em, can be replaced... living beings cannot. I'm sure there's a little boy/girl out there who's happy their dog is still around. Hopefully they'll keep it leashed from now on!

another car on this forum in an accident in the last 2 or 3 weeks...I think that makes 4 or 5 now...that's crazy.
Glad to hear you're ok. I hope the insurance company gives you what you want and the claim is processed smoothly. I would definitely contest the ticket...no harm done in pleading not guilty except for a few spent hours...

Ive seen worse cars in body shop we had couple ferraris and corvettes that were almost riped apart and we fixed them....I wonder if insurance will give you equal compensation they alwas try tu sukc asmuch mone as they can

Sorry to see this happen. I had two cats chase each other across a 4 lane street the other day at night. First cat got pounded by the car just 20 feet ahead and in the left lane. Second cat kept running, I slammed on my brakes and didn't hear anything. After a second or two I started going, but I am sad to say I felt a bump :(.

Damn i just test drove a 3 just like that a week ago. Sorry about the lost. I hope insurance writes a proper check so you can start over. Is the dog on ur avitar the one that ran unto the road? G/L.

So I'm looking at the crash scene and trying to work out what happened (with the aid of some model cars on kitchen table).
The skidmarks show the car going left. The angle of the skidmarks seems to show the tail stepping out to the right. That's a lot of lock up - did you have the DSC turned off?
And then somehow the car flicked 180 degrees once in the median to allow the driver side front to hit the tree.
Did the front dig in and catch when you got into the dirt?
Crazy stuff!

yeah sad to say but it was off. The wheels locked up and the rear shifted around. The right front wheel hit the curb first and did the damage to the rim. Caused the car to rotate faster and whap! Right into the tree. I did the re-enactment for my family the same way...with matchbox cars.

I absolutely love dogs, but my father taught me long ago, if you don't have a good option, hit the dog (or other animal). This could have been a whole lot worse for you or others around you. I know you don't have much time to think in situations like that, but wrecking is usually going to be far worse than hitting a dog. I had to take out a dog once or risk hitting another car on my right at about 50 MPH. I did what I had to do, but I wasn't happy about it.
My mom nearly killed me and my 5 siblings trying to avoid a dog in the road when I was a kid. We wrecked and ended up about 10 feet from a 150 ft. drop into a valley. My dad wasn't there, but when he found out it was over a dog.... man, he was not happy.

Hey Shockdoctor, were you there? Give the man a break. No one from here except him knows what really transpired. Even if he is indeed driving too fast, no need to insult him or anybody for that matter and blame him for jacking up your insurance rates. If you are so worried about paying a big premium on your insurance, get rid of your ultra-performance MS3 and get a 10 yr old Kia that would only need comprehensive insurance. Hope you don't fall on a ditch and come crying here.

if it's totalled and the insurace gives you a big check, buy your car back from them for cheap and take all the parts u can still sell, maybe you can make some money out of it. Sorry about your accident.

Well first of all, I was not speeding. Second of all, I competitively raced in NASA and Autocross clubs everywhere I have been stationed. I do not feel the need to justify myself to the disbelievers out there. In Florida, any accident I was told gets a Careless driving ticket, failure to maintain vehicle. Only way to get out of it is to go to court and talk with a judge. My only issue is that I deploy to South America in a few weeks and there is no time available for a court appearance. I took the pics to justify my case. And to be honest, I was paying $350 every six months on this car with USAA. They said it will go up to approx. $500 every six. The car is not totaled according to the adjuster. He looked at the car in the driveway and did not jack it up to look underneath. Left a break down of everything that had to be replaced and prices for each item. Averaged the local labor rates and stated that car could be repaired in approx 20 days. Grand total of $10,000 minus my deductible.
Any yes, I was for a fact slowing from 50 mph to 40 mph when this happened. Below the posted speed limit. Just because I have modifications done to my cars does not mean I speed. I am not 18 for sure and you looking at my mods to determine that I speed is pretty immature if you ask me.

That car is never going to be the same again. If you ask me, tell the ins. co. OK, take it to their repair shop and hav ethe shop get it on a lift and find more things wrong with it. More repair costs and time might make it a total loss.
Personally I'd never want to drive that car again.....

actually speed3se-r, in a recent nationwide study, silver cars were involved in the least amount of accidents. The number of accidents black vehicles appeared in was overwhelming to silver. This is why I had to go silver, and cause it looks the best imo on most cars.

Sorry about your ride bud. If it makes you feel any better, I had a pic you posted a while back of your ms3 on my desktop. When I saw the flag on your totaled ms3, I wanted to throw up. Sick ride, you next one will be even cleaner!

I have said it before and I will say it again. Unless the animal you're going to hit will do a lot of damage, don't go nuts trying to avoid it. Sometimes its much better to hit the dog, cat, squirl etc. than it is to try to miss it only to do exactly what happened to you.
I myself love animals and would never hurt one, but I have seen way too many cases as this where a person tries to avoid an animal in the road and ends up wrecking their vehicle. I'm very sorry for your loss man. It sucks and the cops should be smacked for giving you a ticket at a time like that.
I had a friend try to avoid a pac of dogs one time and went to the shoulder to go around them. Unknown to him a Tree had fell across the road that day and the city cut it off at the edge of the road vice the shoulder of the road. So when he tried to avoid the dogs he hit the tree doing about 60 (feeder road of the freeway). Needless to say the tree did way more damage than the dogs ever would have.
After about a 3 month stay in the Hospital he told me he will never try to avoid an animal in the road again. He lost his truck after it flipped about 5 times and went through one of those flashing portable signs. He even had to pay for the Sign :(
Again, sorry man as it really sucks to damage your baby.

Man am not sure if i would want that car back after they fix it..its never gonna drive or feel the same..that car should have been considered totaled...hopefully they got all the damages on paper from body to chasis to engine..maybe they did that because of ur rate..damn u aint paying shit for insurance..they dont wanna give u a new car at the rate ur paying they not making any money..

i would also take the ticket to court. anyone who sees those pics of the scene can clearly see you weren't A) speeding B) trying to avoid hitting something in the road.
did anyone see this happen? even if not, that would help your case as there was no one around so you were trying to avoid something other than another car.
just a thought...
sorry about the car, but it's good to see no one and nothing was (other than the car and tree) were hurt.

i just saw the post about you getting deployed. the only thing i can say is go to a ticket clinic place and have them fight it for you. even if it's the same price as the ticket, you wont have the points on your record. also i agree with whitemp5, despute the findings of the inspection and let them know that the car has more damage than he saw. USAA is pretty good about things like that, the only thing they are not good about is paying a good amount for a totalled car.

its goin to be a close call to write it off or not! it dont need a rail so the motor dont have to come out! its gona need an a-piller and a partical rocker! new suspension and maybe aporn assambly and odds and ends. its not that bad!
ive seen worce make it! if u take it to a good shop it will be right! i hate when people bash body shops for something like this! the back door shops make a bad name of the good boys guys! i worked with a guy that put 2 frame rails in a acura and it wasnt more then 1mm off in any direction from stock! a good place can fix this stuff write.
dont always bash the body shop and hope this works out for u man

My wife's best friend in High School ditch her new car to keep from hitting a squirrel. She was not injured but her car was totaled. If the owners cared about the dog it would not have been in the road. I'm not risking my life or my families life and ditching my car. I would stand on the brakes but thats it.

the speed3 has abs, tcs and dsc right??? similar happend to my mazda6... it had abs and tcs... but the brakes locked on me!! WTF? made me lose control................. so uh WTFFF
and btw, its not totaled? take it to a bodyshop you know and have them talk to the adjuster again... my car was NOT claimed totaled when it was at the first shop but then i moved it to another shop and have another adjuster see it... it was claimed totaled, the damage was on driver side btw... you can definitely argue with insurance before you get anyone to fix it... and yea insurance would give you a nice check if its totaled, plus you can tell them the aftermarket parts you have on the car they'll give you whats worth those parts if you have some kind of receipts... good luck with the car man

Not exactly, a lot of times insurance companies won't cover aftermarket mods unless the car was reappraised. If the car is appraised more then its value with the mods (which it will), then that would be an increase on your premiums.
Friend of mine went through that with his insurance co. when he crashed a totally rebuilt RSX. They would only give him 15k which was kbb stock value even though he had over 7k invested in performance parts.
You're better off taking a wrench and pulling the good parts off the car and selling them or keeping them (if the car is considered totaled).

the only reason it totaled some place else was the could of had higher prices for parts and more hours to repair it. every shop does things different. example some will repair a quarter panel and another shop will replace it. just their preference. + when ever we thought something might be a big pain in the butt to fix. we did what we could to total it! jsut not to work on it.
your first shop might of needed the money and wanted to fix it! the second shop might have not wanted to do any to do with repairing you car

My car did a similar thing a little while back. I was on the highway going around 60-65 and I had to slam on the brakes. I was holding the wheel straight and for some reason, the back end of the car was trying to rotate around a little bit. I had to quickly let off the brakes and then put them back on to save from spinning and losing traction (or so it felt). It was almost like the brakes weren't being applied at the same time in the back. Very strange....
Sorry to hear about your car but at least you get a new one now and not a fixed up wrecker.
