The Golden State is now the fifth state to enact such a restriction and in doing so, ended a four-year long struggle, spearheaded by Sen. Joe Simitian, D-Palo Alto. Simitian maintains that mobile phone usage while driving is the number one cause of crashes in California, while opponents of the law believe that distracted drivers, in general, are to blame.

The law will take effect January 1, 2008, imposing a $20 fine for the first offense and a $50 penalty for subsequent infractions, with no adverse affects on the driver's insurance. Motorists using hands-free devices will be exempt from the law.

good, i feel it is a great law since i have seen dumb asses swirving and not paying attention while they hold a phone to their ear! hands free are like 40 dollars and are well worth it imho!!

I don't understand why more people don't use hands-free headsets (wired or bluetooth) - most phones come with the wired ones nowadays anyway!

NY state has a similar law that has been around for acouple of years. I use my headset when I'm on my phone.

Yea I like this law too. There are too many dumbasses that go slow or swirve or just don't know how to drive on the road. And those ppl get worse when they are on the phone. I mean it is not that hard to hold a phone, talk, and drive at the same time. But some ppl just can't.
